LVMAC Tidbit: At Last! An Agent Orange Seminar for the General Public

VVA 415 AO Town Hall Flyer No. 2 19Sep2015Editor’s Note:  We wish to bring your attention to something we consider to be a very special event in the Lehigh Valley — a seminar on Agent Orange not only for veterans, but also their progeny and the general public.  Pennsylvania VVA Chapter 415 of the Vietnam Veterans of America is sponsoring it and is bringing in well-known, national-level speakers, some with academic credentials.  Please note we’re using the term “Agent Orange” as an umbrella term for several different kinds of herbicides used in Vietnam … and in the United States.

You may be asking yourself why invite the progeny of veterans and the general public,  for weren’t the effects of Agent Orange limited to those military veterans who served in Vietnam?   It is because, many believe, more than military veterans have been affected but also their progeny and, additionally, the general public — these products were not only used in Vietnam.  Consequently, the chapter is seeking to heighten their awareness through education and to gain their assistance in pushing needed government research studies long overdue and resisted.  The Congress, the Department of Veterans Affairs and other departments of government may have been turning a blind eye to a matter of importance to all of us.

LVMAC Tidbit — Volunteers Needed for the Wheelchair Games in the Lehigh Valley Suburb of Philadelphia

34th National Veterans Wheelchair Games LogoVolunteers are now being sought to help with the 34th National Veterans Wheelchair Games in Philadelphia during the period 12 through 17 August 2014. The Department of Veterans Affairs and the Paralyzed Veterans of America are “co-presenting” or hosting the Games, the largest of its kind in the world, and expected to attract more than 500 veterans athletes with spinal cord injuries, amputations or serious neurological disorders. VA SEEKING TO PROMULGATE A REGULATORY CHANGE IN HOW IT HANDLES SECONDARY ILLNESSES

LVMAC Poster Art 2005On 7 December 2012 (Pearl Harbor Day), the Department of Veterans Affairs is proposing to change its disability compensation rating rules to  add five diagnosable illnesses which are secondary to service-connected Traumatic Brain Injury (TBI). It would improve the timeliness of decisions.  To accomplish this, the VA proposes to add a new subsection to its adjudication regulation by revising 38 CFR 3.310 to state that if a Veteran who has a service-connected TBI also has one of the five illnesses, then the illness will be considered service connected as secondary to the TBI. VA Expands Medical Forms Program to Support Faster Claims Processing

Previously, we have reported upon the importance of asking the doctor examining you during a compensation claim if he has reviewed the medical information found in your claims file (c-file) before he starts examining you and follow-on steps to be taken if he/she has not.

On the heels of it, the Department of Veterans Affairs has announced the adding of sixty-eight, new forms to help speed the processing of disability compensation and pension claims. This now brings the total number of  these documents known as Disability Benefits Questionnaires (or DBQs for short) to 71. The purpose of the initiative is to better guide physicians in properly completing their reports of medical findings to ensure the Veterans Benefits Administration (VBA — the Regional Office located in Philadelphia in our case) has exactly the medical information needed to make a prompt decision. Each questionnaire addresses a specific set of conditions and associated symptoms for diagnosis. VVA Warns Vets to Get Smart About Compensation and Pension (C&P) Examinations

The Vietnam Veterans of America wants you to know the first question the veteran should ask the VA doctor is, “Have you had a chance to review my claim file?”    If the answer is no, the veteran should ask the doctor to first review the claim file. The veteran should only proceed with the exam after the doctor has reviewed all the information the veteran has submitted and VA has received regarding the claim (the claim file or c-file). (more…)

Disabled American Veterans Re-establish Local Service in the Lehigh Valley

Carmen DeSanti, the chairman of the state’s Disabled American Veterans (DAV) Service Officer Program (the national organization separately provides national service officers at the Philadelphia VA Regional Office), is reestablishing direct, face-to-face service for Lehigh Valley veterans who wish to use the DAV for their Power of Attorney on a disability compensation or pension claim, or to seek benefits advice. Employers Now Can Now Receive Expanded Tax Credits for Hiring Veterans

On 21 November, the President signed new legislation, a portion of which continued and expanded tax breaks to employers who hire veterans.  H.R. 674 became Public Law 112-56 and Title II within it, the section which applies to veterans, is known as the “VOW to Hire Heroes Act of 2011.”

While the bill directs certain federal departments to reform or improve veterans retraining and placement,  includes improvements to  Uniformed Services Employment and Reemployment Rights Act (USERRA), and directs improvements in the somewhat infamous Transition Assistance Program (TAP) — among  other items of interest  — what seems to be grabbing the attention has been a small section on new tax credits found under “Other Matters.” (more…)
